Article 1. Data security and confidentiality

1.1Fit & Trained takes the necessary steps to ensure the security of your personal data. It ensures that your data is protected against unauthorized access, unlawful use, loss, or unauthorized modifications.

1.2Fit & Trained has put in place technical and organizational measures to ensure the security and confidentiality of your personal data.

Article 2. What is personal data?

2.1For the purposes of Article 4, 1° of the General Data Protection Regulation (GDPR), personal data is « any information relating to an identified or identifiable natural person (hereinafter referred to as concerned person); is deemed to be « an identifiable natural person » a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to its physical, physiological, genetic, psychic, economic, cultural or social identity ».

Article 3. Who is the data controller?

3.1Fit & Trained is the data controller of the personal data that it processes in the context of the execution of its services. This implies that it determines, alone or jointly with others, the purposes and means of the processing of this personal data.

Article 4. What personal data are processed and for what purposes are they processed?

4.1The categories of personal data processed by Fit & Trained include the following:

• Identification data (eg name, first name, date of birth);
• Contact data (eg, address, telephone number);

4.2Fit & Trained collects this personal data in particular through its forms.

4.3The processing of this personal data is carried out by Fit & Trained notably for the following purposes:

• A contact request;
• A musical proposal;
• A request for personal training and/or sports coaching;
• The improvement of its services;
• The elaboration of a training programme;
• To perform market research;
• To inform the client about new products, services and information;
• To run promotional campaigns.

4.4Fit & Trained may, in compliance with the General Data Protection Regulation, article 4 of the law of 3 August 2012 and the Royal Decree of 27 March 2015, further process any personal data legitimately collected in the context of the execution of one of its services for the execution of another service.

4.5Your personal data will never be transferred to third parties who would use this data for such commercial or advertising purposes.

4.6Fit & Trained reserves the right to process your details and to use it, when necessary, for:

• Fit & Trained compliance with an obligation it is subjected according to the law, a decree or a regulation.
• The fulfilment of a task of public interest or exercising of public authority assigned to Fit & Trained.
• Handling the justified interests of Fit & Trained.

Article 5. Who are the recipients of your personal data?

5.1In the context of the execution of its services, Fit & Trained may receive or communicate your personal data to the following recipients in particular:

• Yourself;
• A personal trainer and/or sports coach.

Article 6. Storage of your personal data

6.1Your personal data will not be kept longer than necessary for the purposes for which they are processed.

Article 7. How can you exercise your rights?

7.1You can obtain more information about your personal data processed by Fit & Trained on https://fitandtrained.be.

7.2If you find that some of your personal data is incorrect or incomplete or if you wish to exercise your rights, you can submit your request using one of the following forms:

• Data collection form
• Form for requesting deletion
• Data modification form

7.3A copy of your identity card must be attached to any request.

7.4Changes of personal details (change in address, etc.) are personal and may not be done on behalf of a third party.

7.5Your request will be processed within 30 calendar days. If your request is complex or if we receive a large number of requests, this period will be extended by 60 days.

Article 8. Updating of the privacy policy

8.1This policy may be updated from time to time. You are therefore requested to review it from time to time to ensure that you are aware of any updates.

8.2The updated policy will always comply with the General Data Protection Regulation.

8.3The personal database created when registering for Fit & Trained services is confidential.

8.4Fit & Trained also guarantees the confidentiality of the personal data collected when registering for its services. In accordance with the Data Protection Act, all users have the right to access, modify, rectify and delete their data.

8.5Fit & Trained cannot guarantee the confidentiality or the deletion of personal data voluntarily posted by the user in his private messages.

8.6Fit & Trained cannot be held responsible for the « spam » suffered by users who voluntarily and spontaneously decided to publish their email address online.

8.7In the case of a reservation on the https://fitandtrained.be site, Fit & Trained reserves the right to communicate the user's personal data to other people involved (coaches, etc.).
